Terms of Use

1. Agreement and Apple terms

These Terms of Use (the “Terms”) are an agreement between you and Rylan Hayes, an individual developer based in the United States (“Developer,” “we,” “us,” or “our”). They govern your use of the Salus - Health application (“Salus”), its Apple Watch app, widgets, related system extensions, and this website. Salus is independently developed and is not operated by, affiliated with, or acting on behalf of another company.

By downloading, purchasing, accessing, or using Salus, you agree to these Terms. If you do not agree, do not use Salus.

Apple’s Standard Licensed Application End User License Agreement also applies to the app and is incorporated into these Terms. These Terms supplement that agreement. If the two conflict, Apple’s agreement controls to the extent required for an App Store-distributed application. Apple is not responsible for Salus or its content except as stated in Apple’s agreement or required by law.

2. Eligibility and minors

Salus is not directed to children under 13. You must be at least 13 to use Salus. If you are under the age of legal majority where you live, use Salus only with the permission and supervision of a parent or legal guardian. A parent or guardian who permits a minor to use Salus is responsible for the minor’s use to the extent permitted by law.

Exercise, nutrition, and wellness needs can differ for adolescents, older adults, pregnant people, people with disabilities, and people with health conditions. When appropriate, involve a qualified healthcare or fitness professional.

3. General wellness only

Salus displays records, summaries, trends, estimates, scores, comparisons, education, and fitness-planning tools intended for general wellness and fitness use. This includes readiness, recovery, stress, sleep, training-load, Energy Reserve, Fitness Age, nutrition, and similar outputs.

Salus is not a medical device and does not provide medical advice, diagnosis, treatment, rehabilitation, disease prevention, disease monitoring, medication guidance, or injury prediction. A score or trend can be incomplete, delayed, or wrong and must not be used as the sole basis for a health, treatment, medication, dietary, or safety decision. “Fitness Age” is a reference estimate, not a measurement of biological age.

Consult a qualified healthcare professional before starting or changing an exercise or nutrition program, especially if you have symptoms, an injury, a medical condition, take medication, are pregnant, or have been advised to limit activity. Stop activity and seek appropriate care if you feel unwell.

Emergency: Salus cannot detect or respond to an emergency. If you believe you may have a medical emergency, contact local emergency services immediately.

4. Data sources, permissions, and accuracy

Salus depends on information you enter and information made available by Apple Health, iPhone, Apple Watch, supported source apps, wearable devices, sensors, and Apple frameworks. You choose which permissions to grant and may change them in iOS or the Health app.

Available features and results depend on your hardware, software, region, permissions, source-device behavior, wear time, sampling rate, data quality, and the records Apple Health returns. Selecting a Garmin or Amazfit model describes capabilities observed through Apple Health; it does not create a direct Salus connection to that manufacturer. A device shown as selectable may not provide every advertised signal in every configuration.

Data can be missing, duplicated, stale, delayed, misclassified, entered incorrectly, or affected by sensor limitations. Salus uses filtering and provenance rules but cannot verify that every source record is correct. You are responsible for reviewing entries, sources, units, dates, time zones, serving sizes, routes, workouts, and outputs before relying on them.

If Apple Health does not return usable records, Salus shows a missing-data or import-error state. It does not substitute fictional values for your personal data.

5. Nutrition, food, supplements, and label capture

Salus includes an offline catalog derived from USDA FoodData Central and Open Food Facts, along with user-created foods and supplements. Catalog records may include food and brand names, restaurant names, barcodes, serving information, source information, and available nutrient values. Coverage differs by food. A missing nutrient is unknown, not measured zero.

Food databases, manufacturer labels, restaurant data, barcode matches, serving conversions, and optical character recognition can be incomplete, outdated, or incorrect. Products can be reformulated without changing a familiar name or package. A barcode match does not guarantee that the package, serving, market, or formulation in your hand is identical to the catalog record.

Nutrition Facts and Supplement Facts capture processes one photo on the device. Curvature, glare, blur, folds, occlusion, stylized printing, and text outside the photographed side can prevent or distort recognition. Salus marks uncertain readings where possible, but you must compare captured values with the physical label and correct errors before saving.

Nutrition entries are associated with the calendar day selected when they are added. Search history and suggestions are not diary entries and are not included in another day’s totals unless you separately add or intentionally copy them.

Common-food records and branded label records are deliberately shown as different result types. Branded products can differ in ingredients, preparation, serving basis, market, and formulation, so similarly named products may have different calories. Saved recipes total their selected ingredients and divide those values by the serving count you enter; the result is only as accurate as its ingredient records and amounts.

FDA Daily Values shown in Salus are fixed food-label comparison references, not individualized requirements. When enough profile information is available, Salus may separately calculate editable maintenance estimates using age, height, weight, biological-sex choice, and activity inferred from training days. These general estimates do not account for pregnancy, breastfeeding, medical conditions, medication effects, allergies, an eating disorder, or a weight-change goal.

Salus does not determine whether a food, supplement, dose, ingredient, or combination is safe or appropriate for you. It does not screen for allergies, interactions, contraindications, contamination, banned substances, or upper intake limits. Consult a qualified clinician or registered dietitian for medical nutrition therapy, supplement dosing, allergies, eating-disorder concerns, or condition-specific advice.

Cycle estimates, safety cues, Apple Health, and exports

Cycle is an optional general-wellness logging feature available only to adults 18 and older with a Female or Prefer not to say profile choice. It defaults on for an adult Female profile and requires an explicit confirmation before an adult Prefer not to say profile enables it. Its period windows and broad phase context are calendar-based estimates from explicit starts you log. They are not fertility, ovulation confirmation, contraception, conception, pregnancy, diagnosis, treatment, or emergency guidance. Do not rely on them to make a medical, contraceptive, conception, or safety decision.

Gentle messages about a pattern or urgent symptoms do not diagnose a condition, monitor you, or contact emergency services. Seek emergency care when appropriate and discuss concerning patterns with a qualified clinician.

You control local Cycle logs and any PDF or CSV export. Exports can contain sensitive information; notes are excluded unless you explicitly include them, and you are responsible for each person or service with whom you share a file. Apple Health records remain subject to Apple’s controls. Salus can delete only a Cycle sample it created after you separately confirm that action.

6. Subscriptions, trials, and purchases

Salus may offer monthly and yearly auto-renewable subscriptions, eligible introductory trials, and a lifetime non-consumable in-app purchase. The App Store purchase sheet displays the localized price, billing period, taxes if applicable, and trial eligibility before you authorize a purchase. Terms shown by Apple at purchase are part of your transaction.

Auto-renewable subscriptions

Payment is charged to your Apple Account at confirmation. A subscription renews automatically for the same duration unless you cancel it through your Apple Account subscription settings before renewal. Apple controls the exact renewal and cancellation deadline shown for your account and region. Deleting Salus does not cancel a subscription.

Trials and introductory offers

If Apple determines that you are eligible for a trial or introductory offer, the offer converts to the selected paid subscription at the displayed price unless cancelled before the trial or offer ends. Eligibility is determined by Apple and may be limited to one offer per person, Apple Account, subscription group, or family as Apple permits.

Lifetime purchase

“Lifetime” means a one-time purchase that unlocks the applicable Salus features for as long as Salus remains available, supported, and compatible with the Apple Account and platform used for the purchase. It does not mean your biological lifetime, guarantee perpetual availability, guarantee future features, include a different product, or require support for obsolete hardware or operating systems. Mandatory consumer rights are not affected.

Management, restoration, and refunds

Use Salus’s Restore Purchases control to ask Apple to restore an eligible transaction. Manage or cancel subscriptions in your Apple Account settings. Apple processes purchases and controls refunds under App Store policies; Salus does not receive your full payment-card details and cannot directly cancel or refund an App Store transaction. If access does not update after a valid purchase or restoration, contact support.

7. Limited license

Subject to these Terms, Apple’s license terms, and any applicable purchase, Salus grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the app on Apple-branded products you own or control as permitted by App Store rules. Salus is licensed, not sold. No ownership interest transfers to you.

8. Acceptable use

You may not:

• use Salus unlawfully, deceptively, or to harm another person;
• circumvent purchase, entitlement, security, privacy, or access controls;
• reverse engineer, decompile, disassemble, modify, or create derivative works from Salus except where applicable law expressly permits it;
• probe, overload, disrupt, introduce malicious code into, or interfere with Salus or related Apple services;
• remove proprietary, source, attribution, copyright, or license notices;
• use Salus or its outputs to make automated clinical, insurance, employment, eligibility, or other high-impact decisions about another person; or
• misrepresent Salus output as a diagnosis, clinical validation, medical clearance, or guaranteed result.

9. Your content, Salus rights, and open data

You retain your rights in information you enter or select. Salus does not claim ownership of your health records, notes, photos, foods, workouts, or other personal content. You are responsible for having the right to enter or store that content and for keeping your device and backups secure.

Salus, its design, app code, written content, visual system, trademarks, and original materials belong to the Developer or its licensors and are protected by applicable intellectual-property laws. Third-party names and marks belong to their respective owners. Their appearance does not imply endorsement.

The bundled nutrition catalog contains public-domain USDA data and a modified database derived in part from Open Food Facts. Open Food Facts database material is licensed under the Open Database License 1.0, with individual contents under the applicable Database Contents License. Source and license attribution is available in Salus Settings. Those third-party and open-data terms control their respective materials. To request the current machine-readable Salus derivative database under the ODbL, email support@salushealthapp.com.

10. Apple and third-party services

Salus uses Apple services and frameworks such as Apple Health/HealthKit, StoreKit, PhotosPicker, Vision, Core Location, notifications, Local Authentication, widgets, Live Activities, and Watch connectivity. Your use of Apple products and services is governed by your agreements with Apple. Salus is not responsible for third-party hardware, software, data, outages, policy changes, or records those parties make available.

Links on the website or in the app may lead to third-party sites. A link is provided for reference and does not mean Salus controls or endorses the linked service.

11. Availability, changes, and termination

We may add, change, limit, suspend, or remove features to maintain security, reliability, legal compliance, platform compatibility, source accuracy, or product quality. Operating-system, App Store, HealthKit, device, and source-app changes may alter or end functionality. We do not promise that Salus will always be available, error-free, or compatible with every present or future device.

You may stop using Salus at any time. You may delete local Salus data using in-app controls where available and by deleting the app. Deletion does not cancel a subscription or delete original Apple Health records. We may terminate or restrict the license if you materially violate these Terms, subject to applicable law and Apple’s rules.

12. Disclaimers

To the maximum extent permitted by applicable law, Salus and all information, calculations, catalog data, capture results, plans, and features are provided “as is” and “as available,” with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, non-infringement, availability, and results. We do not warrant that Salus will be uninterrupted, secure, complete, current, clinically valid, or error-free, or that defects will be corrected.

Some jurisdictions do not allow certain disclaimers. Nothing in these Terms excludes a warranty, remedy, or consumer right that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by applicable law, the Developer and its suppliers and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, use, opportunity, revenue, or goodwill; personal decisions made in reliance on Salus; or the cost of substitute products or services, arising from or related to Salus even if advised that such loss may occur.

To the maximum extent permitted by applicable law, aggregate liability for all claims relating to Salus will not exceed the greater of the amount you paid for Salus during the twelve months before the event giving rise to the claim or the minimum amount required by applicable law.

These limits apply regardless of legal theory and do not limit liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be limited. Apple’s license terms may provide additional remedies.

14. General terms

Indemnity

To the extent permitted by law, you agree to reimburse the Developer for third-party claims, losses, and reasonable costs arising from your unlawful use of Salus, your material breach of these Terms, or content you use without the necessary rights. This does not require you to indemnify the Developer for its own negligence, misconduct, or violation of law.

Governing law and consumer rights

The governing-law and forum provisions in Apple’s Standard Licensed Application End User License Agreement apply to the app to the extent permitted. If mandatory law where you live gives you additional consumer rights or requires a different law or forum, that mandatory law controls.

Severability, waiver, and assignment

If a provision is unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or transfer of Salus, subject to applicable law.

Entire agreement and changes

These Terms, the Privacy Policy, the purchase terms shown by Apple, and Apple’s applicable license terms are the entire agreement about your use of Salus. We may update these Terms for legal, security, platform, or product changes. The revised date will appear above. When required, we will provide additional notice or request new consent. Continued use after an effective update means you accept the revised Terms to the extent permitted by law.
